U.S. Supreme Court Will Review Kindred Arbitration Case

The U.S. Supreme Court agreed to hear a case involving whether residents of Kindred Nursing Center in Kentucky should be bound by arbitration agreements signed by their agents under power of attorney forms.  In the underlying case, the Kentucky Supreme Court concluded that  "without a clear and convincing manifestation of the principal's intention to do so, we will not infer the delegation to an agent of the authority to waive a fundamental personal right so constitutionally revered as the 'ancient mode of trial by jury'".
